Digital Containers Granted Patent

DCIA Member Digital Containers has received a Notice of Allowance from the US Patent and Trademark Office for its "Delivering Electronic Content" technology. With the approval of this, its third patent application, Digital Containers has been granted protection for a system that allows containerized digital content – for example, a song, video, or travel brochure – to be promoted and the request fulfilled instantly from banner and flash advertising on any peer-to-peer (P2P) network, website, instant message, or e-mail.

When taken in conjunction with the company's two previously awarded patents, "Regulating Access to Digital Content," US Patent No. 6,389,541, and "Tracking Electronic Content," US Patent No. 6,751,670, "Delivering Electronic Content" provides the architecture for a super-distribution system that delivers, protects, tracks, authorizes, and monetizes any type of digital good.

According to Chip Venters, CEO of Digital Containers, "We're very excited about this new patent as it now gives Digital Containers additional intellectual property protection for our super-distribution e-commerce and rights management systems. It complements our other patents by serving as the 'seed' mechanism to get content into circulation. Content owners can now take total control of marketing their goods by placing ads on highly targeted sites, fulfilling orders, and collecting payment immediately and directly from these ads, and tracking exactly which ads users respond best to."

As proof of the potential power of super-distribution, a recent nationwide survey found almost 90% of adult Internet users share content with others according to Sharpe Partners. Three-out-of-five respondents said they shared content at least once a week, 25% do so more frequently.

"Delivering Electronic Content" is a targeted content-seeding mechanism that works in any environment: P2P or centralized network, e-mail or instant-messaging based distribution; creates virtual kiosks by providing instant one-click fulfillment of digital content requests from banner ads, flash ads, and web pages; supports a variety of digital content types: music, video, previews, reports, e-books, brochures, catalogs, travel information, etc.; and works with the family of patented Digital Containers technologies that persistently track and monetize downloaded files.

Seamless P2P Achieves Milestone

DCIA Member Seamless P2P achieved an important milestone in the development of its Secure Private Network (SPN) layer technology for the company's Phenom P2P secure collaborative communications software working with its partner OrionWave.

The Seamless P2P SPN layer allows transmission of data to peers in a transparent manner in conventional IP networks in such a way that information can be shared among peers even if one or more peers are behind proxies, firewalls, or NATs. The SPN layer is a fully extensible platform that will be integrated into Phenom 3.0 as well as future Seamless P2P products.

SPN technology is applicable anywhere a need for secure transparent P2P or lightweight VPN is required, and the SPN layer can be plugged in allowing for rapid development of network applications without building full network layers.

"In addition to being a significant technological achievement," said Luke Rippy, President of Seamless P2P, "proving the functionality and verifying the security inherent in our SPN layer technology keeps us on schedule with our goal of integrating SPN into Phenom 3.0 for launch by the end of the second quarter."

Seamless P2P also announced the availability of a new white paper entitled "Compliance with Regulatory Policies for Security of Wireless Data Transmission" that details the use of encryption to assure compliance with information security requirements promulgated by HIPAA (Health Insurance Portability and Accountability Act), SOX (Sarbanes-Oxley), Department of Defense 8100.2, and the pending Specter-Leahy bill "The Data Privacy and Security Act" (S.1789).

Photo of CEO Marty LaffertyWe commend international law enforcement agencies for their work leading to indictments and criminal complaints this week against twenty-seven individuals allegedly engaged in the distribution of child pornography.

The DCIA also pledges our support of Project Safe Childhood, announced by US Attorney General Alberto Gonzales, to prevent the exploitation of minors over the Internet. We condemn those who abuse distributed computing technologies for such illegal activities.

Support for law enforcement authorities in their prosecution of cyber-crimes – especially those that target children – ranks among our highest of priorities. One of the principal goals of the DCIA and our Members is to help make the peer-to-peer (P2P) file-sharing distribution channel safe and user-friendly for all consumers.

According to the US Department of Justice, a chat-room known as "Kiddypics & Kiddyvids" was used as the dissemination point for thousands of illegal images, including streaming videos of live child molestations, which used the WinMX software program to facilitate redistribution globally.

WinMX's distributor ceased operations last Fall after receiving one of several post-Grokster RIAA cease-and-desist letters, and therefore the application, which continues to freely operate on the web, no longer has a responsible party with whom law enforcement authorities can work to counter this kind of illegal misuse.

The chat-room was maintained by a "host" and various "administrators" who had special privileges, including the selection of participants, some of whom used minors to produce images of child pornography. These were made available to other participants, including by means of streaming video, and were exchanged privately through online instant-messenger services.

Most disturbingly, this operation identified seven new under-age victims of molestation – the youngest of whom was less than 18 months old.

"This international undercover investigation revealed an insidious network that engaged in worldwide trafficking in child pornography, including live molestations of children transmitted over the Internet," said Attorney General Gonzales. "We will continue to work side-by-side with our international law enforcement partners to shut down these rings and protect young, vulnerable victims."

"Molestation 'on demand' and an ever-younger and more defenseless group of child victims are two of the most disturbing trends ICE investigators see when they infiltrate child pornography rings. This case had both," added Assistant Secretary Myers. "I'm so pleased that international law enforcement cooperation has taken down this child pornography ring. Thanks to our cooperative efforts, those who engage in this horrific behavior will not be allowed to roam unchallenged through cyberspace."

The DCIA calls upon all affected parties to join in banishing criminally obscene content from the P2P distribution channel. No right-minded person can tolerate the heinous victimization of children that these images represent, and responsible people need to actively participate in eradicating this scourge. The key question here has to be – what can I do to help? We encourage you to support Peer-to-Peer Parents And Teens React On Line (P2P PATROL).

P2P PATROL is a DCIA-led working group formed in May 2004 with diverse participation from the private sector – including P2P software developers and distributors who have made substantial contributions to its work – as well as federal, state, and regional law enforcement agencies. To date, P2P PATROL has mounted three programs, focusing on education, deterrence, and enforcement, and has been commended by US Senate leaders.

Its educational focus is to provide everyday P2P users with the tools needed to recognize, remove, and report criminally obscene content inadvertently encountered online. For this program, P2P PATROL owes a major debt of gratitude to Association of Sites Advocating Child Protection (ASACP) and Cydata Services for their contribution of the award-winning cpHotline.org as a data processing resource saving literally years of development time and expense.

ASACP provides a self-regulatory vehicle for its members through a Code of Ethics that promotes the protection of children through responsible, professional business practices. In addition, specialized clients have been developed by DCIA Member SMARTguard Software, and password-protected parent filters have been deployed by major P2Ps. According to the most recent Government Accounting Office (GAO) report, leading P2P software program Kazaa, distributed by DCIA Member Sharman Networks, for example, identifies titles and metadata to block pornographic and erotic images, and is markedly more effective in doing so than commercial search engines.

Deterrence focuses on turning back those who may be on the verge of becoming involved in illegal content trafficking, for example by means of pop-up warnings displayed on major P2P software programs in response to certain law-enforcement-supplied triggers: "The search term you entered has been associated with child pornography. Any person who receives, reproduces, or redistributes a visual depiction of a minor engaged in sexually explicit conduct shall be subject to severe fines and imprisonment. P2P PATROL reports suspected violations of Title 18, USC 2252 to the FBI."

P2P PATROL's enforcement program has as its focus supporting the work of law enforcement agencies in identifying, apprehending, and prosecuting abusers of P2P software who perpetrate distribution of criminally obscene material. This has included quarterly working sessions leading to the development and provision of forensics software, the purpose of which is to enhance the productivity of agents conducting P2P investigations, and planning for "THE NEW VOICE OF P2P" fundraiser to financially support further work in this area.

DCIA Member RazorPop's XFiles 2.4 Law Enforcement (XFLE) is the first P2P client software designed exclusively for law enforcement. XFLE software is now available to be distributed at no charge to qualified government agencies to help combat online distribution of criminally obscene content. "It's imperative for child pornographers to know they are not welcome in the P2P environment," said RazorPop CEO Marc Freedman, who personally led XFLE's development. Trymedia's myEarthlink Game Channel

DCIA Member Trymedia Systems, the games division of Macrovision, has partnered with Earthlink, the nation's next generation Internet service provider (ISP), to deploy a fully merchandised downloadable games service to EarthLink subscribers and non-subscribers. The myEarthlink Game Channel gives users access to hundreds of downloadable games in a try-before-you-buy format.

Games which are now available include core titles like F.E.A.R. and Tribes: Vengeance alongside popular casual games such as Luxor: Amun Rising, Super Granny, and Fate. Users download and play full trial versions, and if they elect to purchase a game, it's theirs without further download required.

Trymedia provides a complete outsourced online video game store solution, which gives its ISP and portal customers a continuously updated store with games from developers and publishers around the world.

Nettwerk Music Group & The Orchard

BigChampagne Offers BCDash

The DCIA's official industry data resource, BigChampagne, has launched a new service called "BCDash (BCD)," which offers its media clients on-demand access to real-time data on individual properties, as well as monitors developing trends.

The new dashboard combines information from various P2P networks with sales data from paid services to produce detailed activity snapshots on specific titles and genres, and is very attractively priced, starting in the low thousands of dollars per month.

According to BigChampagne, "The BCD is designed to provide real insight and intelligence on the trends, direction, and development of content online. The world of downloads, streams, blogs, podcasts, mobile, portable subscriptions, social networking, and online communities can't be expressed in a spreadsheet after the fact.

Superstar Potential

The town of Waitsfield, VT (pop. 1,659), is dotted with small businesses led by creative do-it-yourself types. Among them is Grace Potter, 22, a singer and keyboardist who, with her band, The Nocturnals, is on her way to becoming the state's first breakout rock star.

Up until now, all of her albums have been released independently, distributed through manager Justin Goldberg's Indie911, a DCIA Member, self-promoted locally, or sold over the Internet. She and the other band members even live on the same property, in buildings that her parents, Sparky and Peggy (who live just down the hill), constructed for businesses they operated in the 1970s.

Those buildings are also where Potter grew up and started playing piano at age 7, feasting on her parents' collection of 4,000 LPs and performing locally by her late teens. Today, they're where she writes and rehearses the mixture of rock, soul, blues, and funk that's drawing rave comparisons to Bonnie Raitt and Norah Jones.

"There's just a certain sense of truth that she seems to be able to connect with, a pure soulfulness that shakes you to the core," Goldberg says. "I think her potential is unlimited."

That potential was recognized in December by Disney-owned Hollywood Records, which signed Potter to a contract. The label will re-release her latest independent CD, "Nothing but the Water," in April. The deal could make her a superstar, but Potter's ultimate goal is for her music to share a certain characteristic with some of the other solid, well-made items that come out of Waitsfield: durability.

"My long-term goal is to be long-term," she declares. "We're not going with the trends. The music we're making is timeless."

VeriSign Acquires P2P Kontiki

VeriSign, the leading provider of intelligent infrastructure services for the Internet and telecommunications networks, announced that it has signed a definitive agreement to acquire Kontiki, a leading provider of managed P2P delivery systems for high-quality video, software, and digital content.

Kontiki's P2P system will form the cornerstone of VeriSign's broadband content services platform to enable the delivery of rich media over broadband networks to personal computers, television sets, and portable devices.

"In today's 'any era' where consumers are driving demand for how, when, and where content gets delivered, VeriSign is investing in building an intelligent infrastructure for operators, Internet portals, media companies, and consumer brands to use to deliver content to all three screens," said Vernon Irvin, EVP & GM, VeriSign Communications Services.

Kontiki's secure, scalable, efficient P2P platform, which supports distribution of rich digital media over IP networks, is being used by Internet portals, broadcasters, and Fortune 500 companies. AOL, BSkyB, Verizon, and others use the centrally managed system to deliver branded high-quality video content to desktops worldwide. The technology affords economic advantages to customers that want to securely distribute DVD and HD quality video using a system that protects content owner and distributor rights.

Kontiki is privately held and has 34 employees in the US. The acquisition price is approximately $62 million. The transaction is being accounted for as a purchase transaction and is expected to close in the first quarter.

Video-Sharing Network vMix

vMix, an online community for the distribution of video content, has secured its first round of private equity funding from Mission Ventures and Enterprise Partners Venture Capital (EPVC).

vMix offers a global service for personal video sharing among content providers and viewers. Amateurs and professionals can communicate with one another using the powerful medium of video and music. vMix is dedicated to nurturing artists by providing a platform for their music videos to be actively featured and promoted.

vMix offers exclusive tools such as PJ 60, allowing users to create musical slideshows with custom frames from their digital photographs within minutes. vMix uses a proprietary, video content filtering management system to ensure that no obscene material is shown to the public.

The funding will be used to expedite vMix's growth, enhance the site's offerings and product development, as well as expand sales-and-marketing efforts.

"We are thrilled to be a part of vMix during this time of exponential growth within the user-generated content market via hand-held devices and the web," said Robert Kibble, Managing Partner of Mission Ventures. NBX Social Networking Service

Online sports entertainment start-up NBX announced that it has raised $3.3 million in financing led by MK Capital, and introduced its online social network that integrates a fantasy sportsbook, allowing members to "wager" on sports games using virtual currency rather than cash. The free site lets members create their own personal profiles, and uses real sporting events and Las Vegas odds.

NBX also offers podcasts and blogs with sports personalities including the NFL's Kevin Gogan, James Washington, and Gary Plummer, and comedian Jay Mohr. The site is now offering beta versions of the social network and fantasy sportsbook, with final versions expected to launch in April.

SnoCap $15 Million Funding Round

SnoCap, a provider of P2P backend filtering and authorization technology, recently grabbed a $15 million round of venture financing. The third round purse involved Court Square Ventures, as well as previous backers Morgenthaler Partners and WaldenVC.

The influx comes at a definitive juncture for the sanctioned P2P space, which has already seen the introduction of a revamped iMesh, as well as entrant Peer Impact. And high-flying players in the free P2P space, like LimeWire and eDonkey, are expected to soon deliver paid versions of their applications. The investment round was first tipped by PE Week Wire based on a regulatory filing.

Investors are jockeying ahead of a potential new industry, though insiders continue to point to a foggy forecast. Unproven at this point is whether consumers are willing to pay for a filtered P2P experience, or if a more straight-ahead digital download store like iTunes satisfies the demand better.

The easy availability of free downloads skyrocketed P2P network technology, though it remains speculative if that energy can be duplicated within a paid environment. And execution issues have dogged early entrant iMesh. The re-born application, which taps filtering technology from Audible Magic, originally stirred anger among record label executives for allowing early users to access free content from major acts.

Many of those issues have been addressed, though the practical challenges of offering paid content alongside filtered files from the wilds of P2P remain daunting.

Gates Backs Net Neutrality

Microsoft Chairman Bill Gates has tossed considerable support behind so-called "network neutrality" mandates on high-speed Internet-access platforms. "We think there's a sound principle that could be beneficial," Gates said after picking up an award at a Consumer Electronics Association (CEA) dinner.

Gates – before addressing an audience that included Federal Communications Commission (FCC) Chairman Kevin Martin – was seen having a lengthy exchange with House Energy and Commerce Committee Chairman Joe Barton (R-TX), who is developing a bill that would include net-neutrality requirements. "We were having a dialogue about net-neutrality provisions and the benefits those might bring," said Gates.

"He and I agreed on the net-neutrality principle," Barton said later. "Like every other American, Gates wants to know what the details are in the bill. When the time comes, he'll know."

Under net-neutrality rules, cable-company and phone-company providers of high-speed Internet access could not use their network ownership to discriminate against unaffiliated voice, video, and content providers on the web. Discrimination includes blocking services or prioritizing bit-flows to degrade competing services.

"We're not a broadband provider ourselves," Gates said, underlining the threat felt by his and other multibillion-dollar web brands dependent upon unimpeded consumer access. "We're one of many companies that are part of that dialogue."

Barton and Rep. Fred Upton (R-MI), Chairman of the House Subcommittee on Telecommunications and the Internet, are scheduled to meet with subcommittee Republicans to discuss the net-neutrality bill, according to an industry source close to the Committee. Last week, Barton, Upton, and the panel's top Democrats agreed in principle to legislation that would include net neutrality.

CRIA Disputes P2P Claims

The Canadian Recording Industry Association has quietly issued a new study that contradicts many of its own claims about the impact of P2P usage on the music industry.

Michael Geist summarizes the 144 page study by noting that the research "concludes that P2P downloading constitutes less than one-third of the music on downloaders' computers, that P2P users frequently try music on P2P services before they buy, that the largest P2P downloader demographic is also the largest music buying demographic, and that reduced purchasing has little to do with the availability of music on P2P services."
