Federal Communications Commission (FCC) Chairman Ajit Pai this week circulated his Restoring Internet Freedom plan to roll back the 2015 Title II classification of internet service providers (ISPs) in advance of its December 14th Commission open meeting vote.

Chairman Pai’s proposal, which is expected to pass by Republican majority, means ISPs will no longer be considered common carriers subject to mandatory access requirements.

Last month, the DCIA signed-on to an industry letter to the government of China, and we now join a group of more than fifty trade organizations and chambers of commerce in urging officials to delay implementation of a new law that will be harmful to the advancement of cloud computing.

The National People’s Congress’s Standing Committee passed the law in 2016, and supplemental sections published by the government expanded its scope to cover business sectors beyond technology providers, making it even more onerous due to its ambiguous language, restrictive provisions, and anti-competitive regulatory framework.

Following up on last week’s report, the Trump administration confirmed this week that it will require federal agencies to abide by the National Institute of Standards and Technology (NIST) cybersecurity framework and, on a timely basis, report back on their implementation of its recommendations.

Trump’s larger priorities on cybersecurity include controlling and protecting federal networks and their data, safeguarding critical infrastructure, and securing the nation generally from cyber-threats; and his shorter term goals include curtailing botnets and fostering private sector participation in cyber-initiatives – regardless of politics.
